For the purpose of this terms, any reference to “website, company, we, us, our, service” and any similar term shall be referred to Pickle Healthy Delivery Corporation while “you, browsers, vendors, customers, merchants, and/or contributors of contents” shall be the user of www.pickle.ph.

By using and/or purchasing from Pickle Health Delivery, you agree that you have read, understand and agree with all the terms of service stated herein and if otherwise you are advised to discontinue your use.

Any new features, update or tools which are added to the current store shall also be subject to the Terms of Service. We reserve the right to update, modify or replace any part of these Terms of Service at anytime with or without your prior notice. You are hereby advised to review these terms always so as to know if any change has been effected. The new update will be tagged along with date effected. Your continued use of or access to the website following the posting of any changes indicates that you accept those changes.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with Philippine Law.

  • You agree that a breach or violation in any of these terms will result in automatic termination of your service

  • You agree that you will not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws)

  • You agree that you will not transmit any worms or viruses or any code of a destructive nature in the course of using this service.

PRICE

Unless otherwise agreed by Pickle Healthy Delivery in writing, the price for each meal shall be the price assigned by the company on their price list, published at the time of delivery. This price shall also include packaging.

Price adjustments may be made in our sole discretion. By making a Purchase, you agree to pay the fixed Purchase price, which is not to be used for resale or any commercial purposes.

PRIVACY POLICY

All information provided for you on this website is for the sole use of identifying and providing you with quality service especially when it comes to delivery of services. Pickle Healthy Delivery takes your privacy very serious as we will neither lend nor sell out any of your personally identifiable information nor use it for any other activity outside serving you.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

DELIVERY

Pickle Healthy Delivery delivers for free. Delivery schedule depends on your exact location, the week’s route, and road/traffic conditions.

We reserve the right to refuse service or cancel your Purchase for any reason at any time, including but not limited to: product or service availability, errors in the description or price of the product or service, errors in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

No meals on holidays/non-working days.

CHANGE IN PRICES AND TERMS OF SERVICE

Prices for our products are subject to change without notice.

Pickle Healthy Delivery reserves the right to change these terms at any time as we are working towards improving our service(s). We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. When we make any changes, we will notify our users by providing a notice on the website or sending notifications.

It is therefore your responsibility to check the website from time to time to know if there are any changes. The change will be posted with the date it was effected or revised. If you no longer agree to these new changes, you are advised to terminate your account as quick as possible.

PRODUCTS OR SERVICES

Some Products, Services, or Promotions may be available exclusively online through the website. Pickle Healthy Delivery reserves the right, but not obligated to limit the sales of our products or Services to any person, geographic region or jurisdiction.

We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any Products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 

LIMITED LIABILITY

In no case shall Pickle Healthy Delivery Corporation, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any Products. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You use this website at your sole risk as Pickle Healthy Delivery does not guarantee the decency, accuracy, hygienic, reliability, quality and quantity of content/meals obtained from the use of this service.

DISCLAIMER OF WARRANTY

We exclude all warranties, to the extent permitted by law. Asides what is stated in our terms, Pickle Healthy Delivery do not warrant that the quality of our Products or Services purchased by you will meet your expectations, or that any errors in the Service will be corrected.

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free neither do we warrant the accuracy or reliability of results obtained from the use of our service.

You expressly agree that your use of, or inability to use the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions.

SALES REPLACEMENT/REFUNDS

Products purchased/ordered may be replaced or refunded under the following circumstances:

a.    Wrong delivery of product

b.     Wrong description of product

c.     Not satisfied with the product

Never forget to always remove/detach your personal data and order information from the products you are returning. Also, make sure that there are no connected device linked to any cloud account (or any other device) so that the return on sales product may be accepted.

REIMBURSEMENT

All purchases will be refunded by check mailed to the address or deposited back to the account used during ordering/purchasing within 7days of complaint and returns.

PROHIBITED USES

By using Pickle Healthy Delivery, you are prohibited from using the site or its content for the following (but not limited to):

·      for any unlawful purpose

·      to solicit others to perform or participate in any unlawful acts

·      to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances

·      to infringe upon or violate our intellectual property rights or the intellectual property rights of others

·      to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability

·      to submit false or misleading information

·      to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet

·      to collect or track the personal information of others

·      to spam, phish, pharm, pretext, spider, crawl, or scrape

·      for any obscene or immoral purpose or

·      to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

We reserve the right to terminate your use of the Service or any related website for violating any of these prohibited uses.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Pickle Healthy Delivery Corporation and its third parties (parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees) from and against all claims, damages, losses or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us.

If there is a violation or breach in terms and conditions of Pickle Healthy Delivery, your use of our service will be terminated automatically. Also, you agree that we may with or without prior notice, immediately suspend or limit access to the use of our website. The cause of this may include (but not limited to):

      i.         Request by law enforcement or other government agencies for infringement

    ii.         Shutdown or modification to any part(s) of the website

   iii.         Unforeseen technical or security issues

Moreover, you agree that all terminations, limitation of access and suspension to the use of Pickle Healthy Delivery website shall be made in our sole discretion, and we shall not be liable to you or any third party for termination of or access to the website.

ACCURACY OF BILLING AND ACCOUNT INFORMATION 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/mobile number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed erroneously.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our site. You agree to promptly update your information so that we can complete your transactions and contact you as needed.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Pickle Healthy Delivery may recommend certain third-party links on our site in other to provide you with the required service(s). When you click on such links you are automatically directed to such site. You agree to stick to the terms of services applicable to those site(s) as we are therefore not responsible for their services or contents, and you do that at your own risk. You are hereby advised to understand the privacy policy of such sites before clicking on them.

Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

DELIVERY

Unless agreed in writing by the Pickle Healthy Delivery, delivery of products shall take place as notified by the customer to the company at the time the order is placed. The customer is deemed to accept the Goods upon delivery. On every meal plan, there is a free delivery 5days a week with two delivery schedule options.

Pickle Healthy Delivery is usually free and made available in Las Piñas, Makati, Mandaluyong, Manila, Marikina, Parañaque, Pasay, Pasig, San Juan, Taguig, and most areas in Quezon City. Delivery schedule depends on your exact location, the week’s route, and road/traffic conditions.

Any dates specified by the Company for delivery of the products are intended to be an estimate and time for delivery shall not be made of the essence reasonable time.

INSPECTION OF DELIVERIES

You are solely responsible for inspecting all meal ingredients you receive for any damage or other issues upon delivery and for determining the freshness of the ingredients you receive. You should always inspect your delivery to confirm that the meal ingredients arrive in a cool, refrigerated condition.

Orders are dispatched chilled, which will keep them stable and temperature-safe for several hours after delivery. If a delivery cannot be safely left at your address, you are responsible for making alternate arrangements and for changing your delivery instructions in your account if necessary. Any person or location that accepts delivery is presumed by us to be authorized to do so and in accordance with these Terms. You are solely responsible to properly store and refrigerate all products prior to use, including perishables. Failure to follow safe food handling practices and temperature recommendations may increase the risk of foodborne illness.

TERMS OF SALE

(SUBSCRIPTIONS, SKIPPING DELIVERIES, CANCELLATIONS)

Meal Subscriptions: For more information about our Meal Plans and rates please see the “Meal Plan”, “Rates” or “FAQ” sections on the Site.

Cancellation Policy; Skipping Deliveries: You may cancel or postpone your subscription 2 days before scheduled delivery. We shall send confirmation of your cancellation via SMS or email to the mobile number or email address on file. You must complete the cancellation process on-2 days prior to scheduled shipment. Any change made after this deadline will be applied on the next available date. To skip a delivery or pause your subscription, simply send an SMS to our hotlines 0998-978-7255 and await our confirmation. Any Purchase identified as processed or shipped cannot be cancelled.
